Welcome to Vimé & Co. These Terms & Conditions govern your use of www.vimeandco.com and purchases made through the website. They are intended to operate in accordance with applicable South African law.

1. COMPANY INFORMATION

Throughout these Terms, “Vimé & Co”, “we”, “us” and “our” refer to the operator of the website.

These Terms should be read together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy and Cancellation Policy.

2. USE OF THE WEBSITE

By accessing or using the website, you agree to these Terms to the extent that they apply to you.

If you place an order, you confirm that you have legal capacity to enter into the transaction or are acting with the assistance or consent required by law.

3. PRODUCTS AND AVAILABILITY

We take reasonable steps to describe and display products accurately. However, screen settings and photography may cause minor colour or appearance differences.

Product availability is subject to stock on hand and placing an item in a shopping cart does not necessarily reserve it.

Where goods become unavailable after an order is placed, Vimé & Co will notify the customer and provide the refund or other remedy required by applicable law.

4. PRICING

Prices are displayed in South African Rand (ZAR).

Prices include VAT where Vimé & Co is required to charge VAT and exclude delivery charges unless stated otherwise.

If a genuine pricing or technical error occurs, Vimé & Co may contact the customer before fulfilment to correct the error or cancel the affected order where legally permissible.

If an order is cancelled after payment, the amount paid for the cancelled order will be refunded.

Nothing in this clause permits Vimé & Co to avoid a transaction where applicable law requires otherwise.

5. PAYMENT

Payments may be processed through PayFast and other payment methods displayed at checkout.

Orders requiring payment will generally proceed to fulfilment once payment has been successfully authorised or confirmed.

Payment providers process payment information through their own systems. Vimé & Co does not intentionally store customers’ full card or banking credentials on its own website systems.

6. ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase the selected goods.

An automated acknowledgement confirms receipt of the order and does not necessarily constitute final acceptance where stock, payment, fraud-prevention or pricing verification remains outstanding.

Vimé & Co may decline or cancel an order where reasonably justified and permitted by law, including:

  • Suspected fraud
  • Unavailable stock
  • An obvious pricing or technical error
  • Inability to fulfil the order

Amounts already paid for a lawfully cancelled order will be refunded as required by law.

7. DELIVERY

Delivery is governed by our Shipping Policy.

Delivery estimates are provided in good faith and may be affected by courier operations and events outside our reasonable control.

Goods remain at Vimé & Co’s risk until delivered to and accepted by the consumer as contemplated by applicable consumer law.

Ownership remains with Vimé & Co until payment has been received in full, subject to applicable law.

8. RETURNS, REFUNDS AND CANCELLATIONS

Returns, exchanges, refunds and cancellations are governed by our Returns & Refunds Policy and Cancellation Policy.

Nothing in these Terms limits or excludes rights or remedies that consumers have under the:

  • Consumer Protection Act 68 of 2008 (CPA)
  • Electronic Communications and Transactions Act 25 of 2002 (ECTA)
  • Other applicable South African law

9. CUSTOMER ACCOUNTS

Customers may be able to create an account.

You must provide reasonably accurate information and take reasonable steps to keep your login credentials confidential.

Vimé & Co may suspend or restrict an account where there is reasonable evidence of fraud, security compromise, unlawful activity or material misuse of the website, subject to applicable law.

10. PROMOTIONS, DISCOUNTS AND COUPONS

Promotions and discount codes may be subject to stated:

  • Eligibility requirements
  • Validity periods
  • Product exclusions
  • Minimum spends
  • Usage limits

Unless otherwise stated or required by law, promotional codes have no cash value and cannot be applied retrospectively.

Vimé & Co may amend or withdraw a promotion prospectively, but will honour rights already acquired by consumers where applicable law requires this.

11. INTELLECTUAL PROPERTY

Website content, including Vimé & Co branding, logos, original photography, graphics, text, product descriptions and other original material, is owned by or licensed to Vimé & Co unless otherwise stated.

No content may be reproduced, distributed, adapted or commercially exploited without permission except where permitted by applicable law.

Third-party trademarks and intellectual property remain the property of their respective owners.

12. PROHIBITED USE

You may not:

  • Use the website for unlawful or fraudulent purposes.

To the extent permitted by law, Vimé & Co will not be liable for indirect or consequential loss that was not reasonably foreseeable or that arises from circumstances for which Vimé & Co is not legally responsible.

Any limitation of liability in these Terms applies only to the extent that it is lawful, fair and enforceable.

15. CUSTOMER RESPONSIBILITY

Customers are responsible for using the website lawfully, providing accurate information and not causing loss through unlawful, fraudulent or intentionally harmful conduct.

Any claim by Vimé & Co against a customer will remain subject to applicable law.

Nothing in these Terms creates an indemnity that overrides statutory consumer protections.

16. ELECTRONIC COMMUNICATIONS

By using the website, you agree that transaction-related communications may be provided electronically, including:

Performance may be delayed by circumstances outside our reasonable control, including:

  • Courier disruptions

We will take reasonable steps to minimise the effect of such events.

Updated Terms will be published on the website with a revised effective date.

Changes will apply prospectively unless applicable law permits otherwise and will not unlawfully remove rights already acquired under an existing transaction.
